1. General

These terms and conditions govern your use of the website, microsite, or mobile device application (collectively referred to as "Original Wax" or "Store"), owned or operated by AP Energy S.C., hereinafter referred to as "AP Energy," "us," or "we," and establish the terms and conditions for sales made between you—wishing to purchase Original Wax products—and AP Energy.

Please ensure you read and understand these Terms before placing your order. By using the Store and placing orders, you agree to these Terms.

The inclusion of any products or services on Original Wax at a particular time does not imply or guarantee that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

Customers registering in the Store and placing orders provide their personal data and consent to its processing by AP Energy under the terms of AP Energy’s Privacy Policy.

The Customer has the right to terminate the agreement concerning any purchase by submitting a request for cancellation. For this purpose, the Customer should contact AP Energy.

The Customer is responsible for providing accurate personal data. AP Energy reserves the right to refuse to process and cancel an order if the Customer has provided false data or if the data raises reasonable doubts about its accuracy. In such cases, the Customer will be informed by phone or email about the reasons for cancellation. The Customer has the right to explain all circumstances related to the verification of the provided data and the cancellation of the order. In the absence of data allowing AP Energy to process the order, AP Energy will provide explanations after the Customer makes contact.

The Customer is responsible for all transactions carried out using their login and password unless the login or password information was disclosed to a third party through no fault of the Customer. AP Energy will make every effort to protect the login and password from disclosure. The Customer must also take steps to protect their login and password from unauthorized disclosure.

AP Energy is not responsible for the Customer’s disclosure of login or password information to third parties. If the Customer’s email account provided during registration is expired, changed, or deleted, the Customer should inform AP Energy.

The Customer declares that all data provided for processing the order is true, and AP Energy is not obligated to verify its accuracy.

AP Energy aims to provide the best possible online experience. To ensure this, we reserve the right to immediately bar access to the site and close the account of any user who violates these Terms or any other provisions.

Use of the Store is not permitted for individuals under eighteen (18) years of age (or the age of majority in effect in your country).

2. Prices and Delivery Charges

The prices displayed on Original Wax include the statutory Value Added Tax (VAT) for European Union countries but do not include import duties, fees, and taxes upon delivery to third countries. The final purchase price and delivery cost will be presented to the Customer at checkout in accordance with AP Energy's terms of sale.

3. Ordering/Conclusion of Contract

AP Energy has an agreement with third-party service providers to make Original Wax’s products available for purchase and delivery. By placing an order via the Checkout ("Order"), you acknowledge that the seller is the third-party service provider and not AP Energy. Upon successful verification by the third-party service provider of your Order and payment information, the provider will sell the ordered products to you in accordance with their terms of sale.

4. Delivery

Before placing your order, you will be informed of the expected delivery details and cost. Detailed information is available at checkout and in the third-party service provider's terms of sale. Products are shipped from Pawonków (postal code 42-772) at Zawadzkiego 64 Street.

5. Customs Duties & Taxes

All countries within the European Union have VAT included in the final price. Terms and detailed information for orders to other countries are available at checkout and in the third-party service provider's terms of sale.

6. Returns

You may return any item within 30 days of receiving your original order, including sale items. Merchandise must be unworn and unwashed with all tags attached. Exchanges are not accepted, but you can return items for a refund and place a new order for the desired size, color, or item. Duties, taxes, and original shipping charges are non-refundable. Returns are not accepted for personalized soy candles. Detailed information is provided in the third-party service provider's terms of sale.

7. Payment Methods

Available payment methods and all necessary information are provided at checkout and in the third-party service provider's terms of sale.

8. Guarantee

If there are defects in the goods you purchased, AP Energy adheres to all statutory guarantee regulations. If you have a complaint regarding visible material or manufacturing faults in goods, including damage incurred in transit, please return the goods to us promptly using the provided pre-printed return form.

9. Severance

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the remaining Terms shall continue to apply.

10. Ownership of Rights

All intellectual property rights, such as trademarks and copyrights on Original Wax remain with AP Energy S.C. and its subsidiaries or licensors. Any use of Original Wax or its contents, including copying or storing such content in whole or part, other than for personal, non-commercial use, is prohibited without AP Energy’s permission.

12. Final Provisions

Polish law applies to these Terms and Conditions. Any dispute arising out of or relating to these Terms or any non-contractual obligations arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Poland or the jurisdiction of the courts of your place of residence, as provided by applicable law.

These Terms do not exclude or limit any rights of the Customer who is a Consumer, which they are entitled to under mandatory provisions of law. In the event of a conflict between these Terms and mandatory provisions granting broader rights to Consumers, the mandatory provisions shall prevail.

AP Energy reserves the right to amend these Terms for important reasons, including:

a) Adapting them to generally applicable laws,
b) Eliminating provisions that may violate the interests of Customers,
c) Changing or expanding the range of services and goods provided,
d) Adjusting the business profile of AP Energy,
e) Organizational changes at AP Energy.

Customers will be notified of any changes to the Terms by email to the address provided when placing the order.

If changes are made to the Terms, the Store will inform Customers of the new content electronically (to the email addresses provided in the Customer Account or when placing orders) and by publishing the updated Terms on the Store’s website at least 14 days before the new Terms take effect. If the Customer does not accept the new Terms, they may terminate the agreement regarding any purchase by submitting a request for cancellation.

In the event that any provision of these Terms is amended or invalidated by a final court decision, the remaining provisions shall remain in force and bind the parties.
